These Terms of Use ("Terms") govern your access to and use of the FamGuard mobile application and related services ("Service") provided by ATON INC.
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to create a parent or guardian account. Child accounts may be created only by a parent or legal guardian. By using the Service, you confirm that you have lawful authority to manage and monitor the child's device.
By creating an account, you represent and warrant that all information provided is accurate and that you have full legal authority under applicable laws to monitor the child's device and communications. ATON does not independently verify such authority and assumes no liability for misrepresentation.
The Service provides parental monitoring and child-safety features, including:
• Real-time child location tracking (GPS, Wi-Fi, cell towers)
• Location history and movement path review
• Safe Zone (geofence) alerts
• Emergency SOS and rapid parent–child alerts
• Harmful message detection provided on an "as-is" basis, which may not detect all harmful content
• Ambient audio ("Live Surrounding Sound") requested by the parent
• Device status information (battery, network, system indicators)
• Safety alerts, recommendations, and notifications
Harmful Message detection is performed through automated keyword analysis and heuristics only and does not involve human review, contextual understanding, or semantic interpretation. False positives or false negatives may occur. This feature is a supplementary safety tool and not a substitute for active parental supervision.
Features may be added, changed, or removed over time. Certain features may be restricted or disabled in some jurisdictions due to local laws.
Parents or guardians must provide accurate information and are responsible for securing their login credentials. You must not monitor any individual without lawful authority.
You may use the Service only for lawful child-safety purposes. You must NOT:
• Track or monitor adults without consent or legal authority
• Use the Service for harassment, stalking, or unlawful surveillance
• Resell, copy, distribute, modify, or attempt reverse engineering
• Interfere with or disrupt servers or system operations
• Bypass or disable security features
You agree not to violate any applicable laws, including laws requiring all-party consent for audio recording.
The Service collects precise and background location data, including GPS, Wi-Fi signals, and cell-tower identifiers. Disabling location permissions may cause the Service to malfunction. Location accuracy may vary, and ATON does not guarantee precise or real-time accuracy.
Parents may request short, real-time audio samples from the child's device. By using this feature, you confirm that you are the lawful guardian and that the feature is used solely for child safety and in compliance with applicable laws. Audio is transmitted in real time and is not stored on our servers.
Your use of the Service is governed by our Privacy Policy, which describes data collection, usage, retention, deletion processes, and user rights. You must review the Privacy Policy before using the Service.
Some features require a paid subscription. Payments are processed through Google Play or Apple App Store. Refunds follow each store's policy. Subscriptions may auto-renew unless canceled. ATON does not store full payment card information.
We do not guarantee uninterrupted access, error-free operation, or precise accuracy of location or device data. Maintenance or updates may temporarily interrupt the Service.
The Service relies on third-party providers such as operating systems, mapping services, and cloud providers. We do not control or guarantee their performance and are not liable for issues caused by third-party services.
You must not engage in illegal use, violate privacy rights, upload harmful code, attempt unauthorized access, or tamper with Service infrastructure.
We may suspend or terminate accounts for violations, misuse, or fraudulent behavior. Users may delete their account at any time. After deletion, data is retained for 30 days and then permanently erased.
The Service is provided "as is" and "as available." We disclaim all warranties regarding accuracy, reliability, and fitness for a particular purpose. You use the Service at your own risk.
To the maximum extent permitted by law, ATON is not liable for service interruptions, data inaccuracies, unauthorized access due to user negligence, or damages arising from illegal monitoring. Total liability is limited to the amount paid by the user in the preceding 12 months.
You agree to indemnify and hold ATON harmless from claims arising from your misuse of the Service, violation of these Terms, or monitoring without legal authority.
We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Republic of Korea. All disputes shall be submitted exclusively to the Seoul Central District Court. Class or representative actions are waived.

10. Third-Party Services

11. Prohibited Conduct
You must not engage in illegal use, violate privacy rights, upload harmful code, attempt unauthorized access, or tamper with Service infrastructure.
12. Termination
We may suspend or terminate accounts for violations, misuse, or fraudulent behavior. Users may delete their account at any time. After deletion, data is retained for 30 days and then permanently erased.
13. Disclaimer of Warranties
The Service is provided "as is" and "as available." We disclaim all warranties regarding accuracy, reliability, and fitness for a particular purpose. You use the Service at your own risk.
14. Limitation of Liability

17. Governing Law & Dispute Resolution
